TERMS AND CONDITIONS

Scope

  • These Terms & Conditions govern all sales of fresh, chilled, and frozen meat products by FOODS AT JAMS to our customers. By placing an order, you agree to these Terms.

1) Product Specifications & Substitutions

  • We supply meat according to the specifications listed at the time of order (cut, grade, weight range, packaging, halal/kosher status if applicable).
  • Because meat is a natural product, final weights may vary within the stated range. Where applicable, we will invoice the actual weight at the agreed unit price.
  • If an item is unavailable, we may offer an equivalent substitution with your prior approval.

2) Pricing & Taxes

  • Prices are quoted in AED and include VAT unless stated otherwise.
  • Quotes are valid for [7/14] days unless withdrawn earlier in writing.
  • Market conditions (e.g. livestock supply,) can affect pricing; confirmed orders are price‑locked.

3) Orders & Lead Times

  • Cut‑off time for next‑day delivery for orders made between 12a.m and 3a.m if not delivered/collection time will be 7.00 A.M following day
  • Custom cuts/special orders may require additional lead time and are non‑cancellable once processing begins.

4) Delivery, Risk & Title

  • Delivery/Collection: We deliver to UAE (Dubai and Sharjah). (Price will include delivery price within the set radius of operation; additional charges will be charged if the location exceeds the radius of operations), or you may collect from FAJ (Jams logistic Al Qusais) during working hours.
  • Risk: Risk of loss or damage passes to you after delivery to your premises or on handover at collection.
  • Title: Title of goods passes only when we receive full payment of all sums due for the order.

5) Temperature, Handling & Storage

  • We deliver in temperature‑controlled conditions. On delivery/collection, you must promptly place:
  • Chilled products at ≤ 2 to 4°C, and
  • Frozen products at ≤ −16 to-18°C.
  • After delivery/collection, you are responsible for maintaining safe temperatures, handling, and storage in line with recognized food safety practices.
  • Do not consume products past the “use by” date or if packaging/seals are compromised.

6) Inspection & Acceptance

  • At delivery/collection: Please visually check quantities, packaging integrity, temperatures on the delivery note/thermolog (if provided), and product identity before signing.
  • Shortages/damage/wrong items: Note these on the delivery note at handover and notify us at (info@fajfoodsprocessing.com) within [2–4] hours of delivery/collection, with photos and the order number.
  • If no issues are reported within the stated window, the goods are deemed accepted and compliant.

7) Returns & Refunds — Perishable Meat

  • Because meat is highly perishable and temperature‑sensitive, we do not accept returns once goods have been delivered/collected, except in the following cases reported within [2–4] hours and supported by photos/evidence:
  • Wrong items supplied (e.g., different cut/spec).
  • Damaged or compromised packaging at delivery.
  • Observable temperature abuse at handover (e.g., tamper‑evident indicator triggered) verified by our team.
  • How we resolve: At our discretion, we will (1) replace the affected item(s) promptly, or (2) issue a credit note/refund for the affected portion only. Products must be kept refrigerated/frozen and not used while a claim is assessed.
    No returns are accepted for taste preferences, color variations within normal ranges, or where storage/handling conditions after delivery were not followed.

8) Payment Terms

    • Choose the options that apply to your business model:

A. Online Orders (Prepaid):

      • Payments via Visa, Mastercard, American Express, Apple Pay, etc. are charged at checkout.
      • Prepaid amounts are non-refundable once the order is released for processing;
        if an item is unavailable, a replacement of the same value will be offered to the customer’s satisfaction.

B. Cash / Transfer on Delivery (COD / Bank Transfer):

      • Full payment is due at delivery by cash, card, or instant bank transfer.
        Goods may not be released until payment is confirmed.

9) Order Changes & Cancellations

  • Standard items: You may amend/cancel before processing starts.
  • Custom cuts/special orders: Non‑cancellable once preparation begins; you are liable for the full amount.

10) Quality, Warranty & Limits of Liability

  • We warrant that products meet the agreed description and are fit for human consumption at the time of delivery/collection, provided they are stored and handled correctly thereafter.
  • Except as required by law, we exclude all implied warranties. Our total liability for any claim related to an order is limited to the invoice value of the affected goods. We are not liable for indirect or consequential losses (e.g., business interruption or loss of profit).

11) Product Recall

  • If a recall is required, you agree to cooperate promptly, including tracing lots, removing affected stock, and communicating with your customers as instructed. Our liability remains limited as set out above.

12) Force Majeure

  • We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., supply disruptions, transport failures, extreme weather, governmental actions).

13) Compliance & Food Safety

  • You agree to follow applicable food safety and hygiene regulations when storing, processing, or reselling our products. We may provide general handling guidance, but you remain responsible for your premises, equipment, and staff practices.

14) Privacy

  • We process customer data to fulfill orders, provide support, manage accounts, and meet legal obligations. We uphold customer confidentiality and we do not share customers information without consent

15) Governing Law & Dispute Resolution

  • These Terms are governed by the laws of UAE. Disputes will be submitted to the courts of UAE, unless otherwise required by consumer law.
